Limited Warranty: Diversified Precision Products does not give any warranty on its products except as follows: Diversified Precision Products warrants to original equipment manufacturers, distributors and industrial and commercial users of its products that each new product manufactured or supplied by Diversified Precision Products shall be free from defects in material and workmanship. Diversified Precision Product’s sole obligation under this warranty is limited to furnishing, without additional charge, a replacement for, or at its option, repairing or issuing credit for any such product which shall within one year from the date of sale by Diversified Precision Products be returned to Diversified Precision Products and which upon inspection is determined by Diversified Precision Products to be defective in materials or workmanship. The provisions of this warranty shall not apply to any product which has been subjected to misuse, improper operating conditions or machine setup, improper application of cutting fluid; or which has been repaired or altered if such repair or alteration in the judgment of Diversified Precision Products would adversely affect performance of the product. Complete written information with respect to all such matters, including operating condition, machine setup, cutting fluid, cutting speed and feed rate, must be furnished to Diversified Precision Products as a prerequisite to its consideration of any claim or complaint under this warranty.
This warranty is in lieu of all other warranties, expressed or implied, including any implied warranty of merchantability or fitness for a particular purpose. Diversified Precision Products shall have no liability or responsibility on any claim of any kind, whether in contract, tort or otherwise, for any loss or damage arising out of, connected with, or resulting from the manufacture, sale, delivery or use of any product sold hereunder, in excess of the cost of replacement or repair provided herein. In no event shall Diversified Precision Products be liable for any special, incidental, or consequential damages. Diversified Precision Products makes no other warranty, expressed or implied, except the warranty against defects in material and workmanship set forth above; and Diversified Precision Products neither assumes nor authorizes any other person or entity to assume for it any other obligation or liability in connection with any of its products.
Production Quantities
Diversified Precision Products reserves the right to over ship or under ship by 10% or 1pc whichever is greater of the original order quantity unless customer purchase order specifically disallows.
Returns Returned defective products must be accompanied by a Diversified Precision Products authorized Customer Return Number (CRN). Contact customer service to speak to a representative. Blue print specials, modified, non-catalog or altered tools are not acceptable for return unless they are defective.
Test Tool Policy
Diversified Precision Products will provide test tools for production testing on a pay for performance basis as long as an accompanying customer PO is issued to invoice against for successful test results. Test tool prices will be at the prevailing normal order quantity unit price. Diversified Precision Products will authorize a test tool credit when the test tool results do not meet the agreed upon performance metrics. Partial credits may be issued when warranted.
Governing Laws
Michigan law shall be the governing law to any dispute or conflict that arises under these terms and conditions.
Material Grades
Diversified reserves the right to substitute equivalent or superior material grades or manufacturers’ from that which are specified on the customer print.
Warning
Because cutting tools may shatter or break, government regulations require the use of safety glasses and other safety equipment at all times in the vicinity of cutting tool use. Grinding of solid carbide or carbide tipped tools will produce carbide and braze dust that may be hazardous to your health. Adequate ventilation should be used.
